Podcast Participation & Consent Terms

1. Rights and Consent

The Client acknowledges that by participating in podcast recordings arranged through PodZeal, they consent to the audio and/or video recording of their voice, image, likeness, and performance by the respective podcast host (the “Host”).

The Client agrees that:

• The Host retains full ownership of the podcast episode, recordings, and related content (“Program”).
• The Host may use, edit, distribute, publish, and promote the Program in any format or media, now known or later developed, in perpetuity.
• PodZeal does not claim ownership of the Program or any related materials.

2. Role of PodZeal

PodZeal acts solely as a facilitator to:

• Identify relevant podcast opportunities
• Conduct outreach and secure bookings
• Coordinate scheduling and communication

PodZeal is not responsible for:

• Content produced by the Host
• Editing, publishing, or distribution of episodes
• Decisions made by the Host regarding usage of the recording

3. Promotion and Publicity

The Client agrees that:

• Podcast Hosts may use their name, likeness, voice, and provided information for promotional purposes related to the Program.
• PodZeal may reference the Client’s podcast appearances for portfolio, case studies, and marketing purposes unless otherwise agreed in writing.

4. No Compensation

The Client understands that:

• Podcast guest appearances arranged through PodZeal are typically unpaid unless explicitly stated otherwise.
• PodZeal does not guarantee paid podcast opportunities unless agreed separately.

5. Guarantee of Outcomes

PodZeal guarantees the delivery of the number of podcast bookings outlined in the selected plan, provided the Client:

• Responds in a timely manner
• Is available for scheduled recordings
• Provides required information and approvals

PodZeal does not guarantee:

• Acceptance by specific podcast hosts
• Audience size, reach, or engagement
• Business outcomes such as leads, sales, or revenue

6. Release of Liability

The Client agrees to release and hold harmless PodZeal from:

• Any claims arising from podcast recordings, publication, or distribution
• Actions or decisions made by podcast Hosts
• Any indirect or consequential damages resulting from participation

7. Client Responsibility

The Client agrees to:

• Attend scheduled recordings on time
• Maintain professionalism during podcast appearances
• Provide accurate and non-infringing content

8. Legal Capacity

The Client confirms that:

• They are at least 18 years old
• They have full rights to share the information discussed
• Participation does not violate any agreements or obligations

9. Acknowledgment

By engaging PodZeal’s services, the Client acknowledges and agrees to these terms and understands that PodZeal operates as a service provider, not the content owner or publisher.
